Terms and conditions of sale

These terms govern every order placed on the filonmedoc.com online shop. In particular they set out the prototype approval cycle specific to customised items, how Mollie payments work, and your rights as a consumer.

English translation, provided for information only. Only the French version of these terms is legally binding; it prevails in the event of any discrepancy.

1. Preamble and scope

These terms and conditions of sale (hereinafter the “Terms”) govern, without restriction or reservation, all sales concluded on the site https://filonmedoc.com between:

The seller:
Dorian BIEGUN, trading as “Filon Médoc”, sole trader (entreprise individuelle), 72 ter route du Bourg, 33590 Talais, France, SIRET 101 561 801 00016 (hereinafter “the Seller” or “Filon Médoc”).
The customer:
Any natural person of full age acting for their own personal, non-professional purposes (“the Consumer”), or any legal entity, placing an order through the site (hereinafter “the Customer”).

Placing an order implies full and unreserved acceptance of these Terms, to the exclusion of any other document. The applicable Terms are those in force on the date the order is confirmed.

The Seller reserves the right to amend these Terms at any time; the new Terms will apply only to orders placed after they are published online.

2. Products and customisation

The Seller offers objects 3D-printed in its workshop in Talais (Gironde, France), in particular custom keyrings and NFC stands. The essential characteristics of each product (materials, dimensions, options, dispatch time) are set out on the corresponding product page.

Photographs and 3D renders shown on the site are illustrative; they do not constitute a contractual commitment as to the exact appearance of the finished product, which may show slight variations due to:

  • the batch of filament used (shade of colour, gloss);
  • the tolerances inherent to fused deposition 3D printing;
  • hand finishing (sanding, deburring) carried out in the workshop.

These variations are inherent to the craft process and cannot justify rejecting an order, provided the delivered product remains in line with the agreed specifications and the approved prototype.

3. Ordering process

Ordering a customised item follows these steps:

  1. Configuring the product on the dedicated customisation page (colours, engraved text, chain, NFC options, logo upload, detailed brief);
  2. Adding to the basket and checking the summary;
  3. Entering the delivery address, contact email and shipping method;
  4. Explicitly accepting these Terms and confirming payment through the provider Mollie;
  5. Receiving a confirmation email with the invoice attached and the order number in the format FM-YYYY-XXXX.

Every order constitutes acceptance of the prices, descriptions and these Terms. The Seller reserves the right to refuse or cancel any order showing anomalies (disputed payment, implausible address, brief manifestly contrary to public policy or to third-party rights). Any amounts already collected are then refunded in full through Mollie.

4. Prices and payment

Prices shown on the site are in euros (€), all taxes included. The Seller falls under the VAT exemption scheme provided for in article 293 B of the French General Tax Code: invoices carry the mandatory wording “TVA non applicable, art. 293 B du CGI” and no VAT amount may be deducted by the Customer.

Shipping costs are calculated at payment time based on the weight of the parcel and the shipping method chosen. They are clearly displayed before the order is finally confirmed.

Payment is made exclusively online through the secure platform Mollie B.V. (Keizersgracht 313, 1016 EE Amsterdam, Netherlands). Depending on availability, the following are accepted: bank card (Visa, Mastercard), Bancontact, Apple Pay and Google Pay. No bank details are stored on the Seller's servers.

Payment is due immediately on ordering. The order is deemed accepted only once payment has actually been received, as confirmed by a webhook issued by Mollie.

5. Prototype approval cycle

⚠️ An essential step, specific to customised items. The Customer acknowledges having been informed of it when ordering.

After payment is received, the Seller sends the Customer, within an indicative period of 3 to 5 working days, a digital prototype (3D render and/or a photograph of a test piece) via a secure magic link sent by email. This link is valid for 30 days.

The Customer then has the following options:

  • Approve the prototype: the production run then starts immediately;
  • Request a revision, setting out in writing the changes wanted: a new prototype is then offered within a reasonable time.

The number of revision rounds is limited to three (3). Beyond that, any further substantial request may be subject to an additional quote, or to an amicable cancellation with a partial refund after deduction of the design costs already incurred (up to a maximum of 30% of the amount paid).

No response: if the magic link expires without approval or a revision request, the Seller will contact the Customer by email. If there is no reply within a further 30 days, the order will be presumed approved by tacit acceptance and production will start on the basis of the last prototype sent.

6. Production and delivery

After the prototype is approved, production takes an indicative 7 to 14 working days, on top of which comes the transit time of the carrier chosen.

The shipping methods offered on orders delivered in mainland France are:

  • Colissimo (La Poste): tracked home delivery, 48 to 72 hours;
  • Mondial Relay: delivery to a pickup point, 3 to 5 working days;
  • Hand delivery: free within the Médoc, by appointment at the Talais workshop.

Delivery is free on any order of €100 incl. tax or more (excluding hand delivery, which is always free).

The stated lead times are indicative and not contractual. They run from the approval of the prototype, not from the order date. In the event of a significant delay, the Customer will be informed by email as soon as possible.

The risk of loss or damage passes to the Consumer at the moment they (or a third party designated by them, other than the carrier) take physical possession of the goods (article L. 216-4 of the French Consumer Code).

If a parcel is visibly damaged on delivery, the Customer is asked to make precise written reservations to the carrier at the point of handover, and to inform the Seller within 3 days by email at [email protected], attaching photographs of the parcel.

7. Right of withdrawal: a major exception

⚠️ Items made to the Consumer's specifications or clearly personalised do NOT carry a right of withdrawal, under article L. 221-28 3° of the French Consumer Code.

As almost all Filon Médoc products are customised (choice of colours, engraved text, logo, back face, and so on), the Consumer expressly acknowledges, when confirming the order, that they waive their 14-day right of withdrawal for the items concerned.

However, should the Consumer order a shop item available in a standard, non-customised version, they benefit from the right of withdrawal provided for in article L. 221-18 of the French Consumer Code. They then have 14 calendar days from receipt of the goods to withdraw, without having to give reasons or bear any cost other than return shipping.

To exercise this right, the Consumer may:

  • send an email to [email protected] clearly stating their order number and their intention to withdraw;
  • or copy out the standard withdrawal form (annex to article R221-1 of the French Consumer Code) and send it by post or email to the same address.

Where withdrawal is validly exercised, the Seller refunds all sums paid (products + outbound delivery costs) no later than 14 days after receiving the return, using the same means of payment as the order. Return shipping costs remain payable by the Customer. The goods must be returned in their original packaging, unused, no later than 14 days after notice of withdrawal, to the Seller's registered address.

8. Statutory guarantees

Independently of any commercial warranty, the Seller remains liable for lack of conformity of the goods with the contract and for latent defects under the conditions set out in articles L. 217-4 to L. 217-14 of the French Consumer Code and 1641 to 1648 of the French Civil Code.

Statutory guarantee of conformity: the Customer has 2 years from delivery of the goods to bring a claim. They may choose between repair and replacement of the goods, subject to the cost conditions provided for in article L. 217-9 of the French Consumer Code.

Guarantee against latent defects: the Customer may also bring a claim for latent defects within the meaning of article 1641 of the French Civil Code within 2 years of discovering the defect, and obtain either rescission of the sale or a price reduction.

9. Liability and force majeure

The Seller cannot be held liable for non-performance or improper performance of the contract in the event of force majeure within the meaning of article 1218 of the French Civil Code (in particular: exceptional weather, fire, widespread power failure, carrier failure, health crisis, government restriction).

The Customer warrants that they hold the rights to any logo, text or artwork they send to the Seller for customisation, and indemnifies the Seller against any third-party claim alleging infringement of intellectual property or privacy rights. The Seller reserves the right to refuse any customisation manifestly contrary to public decency or public policy, or liable to infringe a third party's rights.

10. Personal data

Personal data collected when ordering (identity, address, email, phone) is necessary to perform the contract. It is kept for the statutory period (10 years for accounting records). The Customer has the rights of access, rectification, erasure and objection provided for by the GDPR.

11. Complaints and mediation

Any complaint must be sent first in writing to [email protected]. The Seller undertakes to reply within a reasonable time.

In accordance with articles L. 611-1 et seq. of the French Consumer Code, a Consumer who does not obtain satisfaction or a reply within 2 months may refer the matter free of charge to the consumer ombudsman covering the Seller:

The Consumer may refer the matter to CM2C free of charge within a maximum of one year from their written complaint to the Seller.

The Customer may also use the European online dispute resolution (ODR) platform made available by the European Commission.

12. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute not settled amicably, the competent court will be, for the Consumer, that of their place of residence or that of the place of performance of the contract, at their choice (article R. 631-3 of the French Consumer Code).
